The changing law of causation and how it affects insurance claims

In this IIL claims webinar, Sam Sharp gives an overview of the recent developments in the law of causation, and addresses how they affect key policy terms and the claims process and how the Courts have interpreted causation in insurance.

Developments in the interpretation of causation language affect all classes of insurance policy and need to be understood by those who are involved in handling claims. This webinar gives an overview of the key points to bear in mind when applying the causation requirements within all classes of policy wording, including exclusions, write-backs, and aggregation provisions.

There have been several recent cases in which the Courts have looked at how to interpret causation in insurance policies. Notably, these include University of Exeter v Allianz, Brian Leighton (Garages) v Allianz, and Spire Healthcare Ltd v RSA. These all come after the Supreme Court decision in FCA v Arch.
