This YMC webinar will outline the importance of carefully drafting policy wordings and mid-term endorsements, and what can go wrong with seemingly insignificant changes if not drafted with clarity in order to achieve contract certainty.

As insurance practitioners, we are often drafting seemingly minor changes to policy wordings, defining interests, and setting policy conditions. But what can go wrong if things aren’t interpreted as intended?

Michael Howard FCII and Hattie Alvis will consider the framework for writing insurance contracts, the legal interpretation of different words and conditions, and evaluate past failures and lessons learnt when things go wrong.

Learning objectives:

  • Understand the framework for interpretation of policy wordings

  • Understand the importance of drafting insurance contracts with absolute clarity

  • Understand the application of underwriters’ intention compared to case law

  • Evaluate example failures and what can go wrong when conditions are ambiguously drafted
