It's not always the horse's fault - a look at the Animals Act 1971

In this IIL accident webinar, Jonathan Hand and Bruce Ralston discussed defending claims for personal injury brought under the Animals Act 1971, with a focus on the areas which are most commonly in dispute and gave practical guidance about how to deal with them.

Claims for strict liability under the Animals Act are particularly challenging because of the complex wording of the Act and the difficulty in applying its provisions to the wide range of factual situations which arise.

This webinar looked at the areas which are most commonly in dispute, namely whether the conditions for strict liability in s.2(2) of the Act are made out – with particular reference to recent cases relating to what is “dangerous” behaviour under sub-paragraph (a) – and whether the statutory defence of voluntary acceptance of risk can be relied on.

Drawing on their wide experience of handling these claims, the speakers looked at practical examples of how to manage disputes under the Animals Act involving personal injury caused by horses and other animals.
