Fraudulent Insurance Claims: Versloot Dredging and the 2015 Act

In this IIL London Market lecture Tom Bird focused on the fraudulent insurance claims and the change in the law brought about by the Supreme Court's judgment in Versloot Dredging and the Insurance Act 2015.

In Versloot Dredging v Gerling (The Merwestone) the Supreme Court held that the use of 'collateral lies' does not lead to forfeiture of insurance claims. Tom Bird and his colleague Ben Gardner, were Counsel for the Appellants and Respondents. Tom discussed the implications of the judgment and the changes introduced by the Act 2015.

By the end of this lecture members would have gained an insight into:

  • Changes to the law on fraudulent insurance claims
  • Implications of the Versloot v Gerling judgment
  • Whether insurers can get around the decision by inserting express clauses

Speakers Bio:
Tom Bird is barrister specialising in insurance law. He, and his colleague Ben Gardner, acted for the Appellants and Respondents respectively in the appeal to the supreme court in Versloot Dredging v Gerling.
