The Insurance Institute of Guernsey is holding Development Day Morning hosted by Jeff Heasman at Les Cotils on Wednesday 12 November 2025.

There have been a number of Court of Appeal and Supreme Court decisions over the past couple of years that have significantly impacted the way that we should be working within insurance and financial services. Recent insurance fraud statistics from various sources have also revealed some very interesting (and in some cases, worrying) trends. Join us on 12 November for Breakfast at Les Cotils from 8:30am (9:00 am breakfast will be available) until 12:00 pm for three sessions delivered by internationally renowned expert and trainer, Jeff Heasman (Insurance Upskill) as we examine these recent court judgments and gain insight into current insurance fraud trends.

Session 1: When a Lie is Dishonest but the Claim Isn´t: developments in the law relating to fraudulent devices

This thought-provoking session focuses on how the law relating to fraudulent devices has developed since the Supreme Court decision in Versloot Dredging BV v HDI-Gerling Industrie Versicherung AG (The DC Merwestone) and how insurers’ remedies have been impacted by the provisions of the Insurance Act 2015, ten years later.

The background to the development of the law relating to fraudulent devices will be examined and we will discuss expected future trends in court decisions relating to this ever-evolving area of law, which has ushered in an era of the defence of “collateral lies”.

Session 2: When the Computer Says No: strategies for getting around automated systems

Decision-making is becoming increasingly automated in insurance and financial services. But what happens when a client does not agree with the decision that has been made? What are their legal rights? How can we support them? In this session, we will examine:

  • the advantages and disadvantages of automated decision-making.
  • the rights that clients have under law to challenge the decision made.
  • the ways you can support your client when they are subject to an automated decision with which they do not agree.

Session 3: The Court of Cards: The Supreme Court, Casinos and Insurance Fraud

It feels like the law relating to insurance fraud is in constant motion. The courts have been grappling with tests such as “fundamental dishonesty”.

But could it be that a case involving alleged cheating in a game of baccarat in a casino in London has brought some clarity to how the courts will deal with the test of fundamental dishonesty in insurance claims?

The session provides for 3 hours of CPD.

The Insurance Institute of Guernsey is in the fortunate position of being able to subsidise this event, and the fee for attending is £55 per person.
