Vulnerability has become an important topic for any firm offering professional advice to individuals who may, as a result of their personal circumstances, be particularly disadvantaged when making key financial decisions.
Thanks to the FCA and others, there is a reasonable supply of guidance with regard to the characteristics of vulnerability, and the impact . What is less clear is what exactly we are supposed to do when we have identified a potential problem. How do we record it, what can and can’t we say to the client and/or their families and what documentation should be in place both before and after vulnerability has been identified.

  • The legal aspects of dealing with vulnerable clients, including the set up and activation of Power of Attorney
  • Professional standards for dealing with vulnerable clients

The session will have a focus on Scots Law and FCA regulation but will be of interest to any one dealing with clients at a firm or individual level.
