A long-established class of insurance, employers’ liability cover tends to be provided as an element of a commercial package policy. Being a compulsory form of cover, it is an “ever-present” in such policies and consequently the detail can be easily overlooked.

The hour-long session explores the fundamentals of cover and also looks at recent cases concerning the status of people working for organisations and how this affects the application of cover.

Course Objectives

By the end of this session delegates will

  • Understand the need for and compulsory requirement for employer’s liability insurance
  • Know how liability can attach to employers for death, injury or disease sustained by employees in the course of their work
  • Be aware of who would be considered an employee for the purposes of policy cover
  • Understand the impact of recent legislation and legal decisions upon the provision of employers liability cover

Course Content

  • Brief precis of policy cover.
  • Who is considered an employee in accordance with policy cover?
    • Considerations and legal decisions concerning the “gig economy”.
    • The impact of the Employment Rights Act 1996
  • Why might employer’s be liable and legislation placing an onerous duty of care upon employers.
  • The difference between proscriptive legislation and that imposing a test of reasonableness
  • Issues arising from latency including the Mesothelioma Act 2014.

Trainer David Hole

Experience: David is an experienced insurance professional with a career spanning 40years; he has enjoyed wide exposure in the London Insurance Market and elsewhere resulting from his industry- specific training activity.

His experience includes Head of Claims at Plum Underwriting Ltd, where he was responsible for managing the relationship between insurers and claims third party administrators, handling larger claims received via technical referral processes.
