During this interactive workshop, we will take delegates through an investigation that has not gone well. This involves a replay of the various stages and decisions that have to be made, highlighting the common pitfalls, and how to avoid them.

This is a very practical session that will leave delegates with greater confidence should they ever need to provide advice on how to deal with a serious incident investigation.

Learning Objectives:

  • “There has been an incident” - How do you deal with this first call? What immediate steps need to be taken?
  • Powers of the Police/ HSE - What power does the Regulator have, and how should you respond.
  • Document requests from Regulators - What are you required to hand over at the scene and how do you deal with requests for information and documents.
  • Witness interviews - When should they take place, and what options do witnesses have.
  • Health & Safety offences - Who has committed an offence in this case and what penalties may apply.
  • The Press - They ask you for comment. How do you deal with this?
  • Investigation Report - How to protect the report under legal privilege.
  • RIDDOR - Common issues we see when reporting incidents to the HSE.
  • Sentencing - We look at how courts approach sentencing
  • Health and Safety cases Review - We review mistakes made during the investigation and how they could have been avoided.

Speaker: Emma Bowens, Partner: Regulatory - Safety, Health and Environment

Emma Bowens is a specialist in Safety, Health and Environmental law and she has over 25 years experience in legal practice.

Emma can help clients avoid prosecution by reviewing their approach to achieving compliance. This includes advising on policies, identifying common problems that tend to result in prosecution, and identifying non-compliance/ risk trends within an organisation.

Emma helps clients to prevent incidents by advising on workforce engagement and training. She has a proven track record for delivering training with impact. Several of Emma’s clients have achieved a significant reduction of incidents (up to 85%) and have gone on to win awards for their achievements in health and safety. Her popular mock trials are a powerful reminder of what can happen when safety standards slip. Many delegates walk away from her sessions with action points that they are motivated to deliver, to make sure they are never in the same situation.
