In this IIL accident webinar, Richard Lawrence and Michael Salau discussed the complexities of waste legislation/regulations and how breaches can give rise to a claim under an insurance policy.

The webinar also provided an overview of the potential costs associated with these claims and an understanding of how coverage may vary under different types of policy in the market. Richard focussed on two case studies, both of which relate to claims made under an insurance policy for the illegal importation, processing or depositing of waste on an insured premise. He discussed where/how a legal liability attached to the insured party and how the policy responded (or did not as the case may be). He also talked about how policy cover can differ for this type of incident both under the more standard commercial forms and also under environmental impairment policies.

Michael summarised waste legislation and how legal liabilities may attach to 'innocent' landowners and site operators.

By the end of this webinar members would have gained an insight into:

  • Waste regulation/legislation
  • How a claim arising from breaches of legislation may result in an insurance claim
  • How coverage may vary under different types of policy in the market
