D-Day is upon us!! The first Monday in January is the day when matrimonial lawyers traditionally brace them themselves for a spike in new enquiries as couples who have been ‘keeping it together’ over the holiday season feel their duty is done and start to look to the future – apart. Much work has been done in recent years on the treatment of pensions within a divorce, not least by the Pensions Advisory Group (PAG), a collaborative body building on the expertise of family law experts, consulting actuaries, scheme trustees, academics and financial advisers. In July 2019 they published the first truly cross-functional study into pensions on divorce, followed by the second edition in 2024. Invaluable as this guidance is, it was perhaps unsurprisingly based on English Law. The Insurance Society of Edinburgh is offering an event which puts PAG into a Scottish perspective, helping practitioners to identify and understand the areas of commonality and the key differences under Scots Law. The session is primarily aimed at financial advisers active in the pensions market, but we will be happy to welcome anyone with a professional interest in pensions on divorce.

Global threats facing the insurance industry
What are the global threats facing the insurance industry right now and how are these impacting UK insurers and brokers? Today war, weather extremes and the cost of living crisis dominate public debate but the sector faces critical risks – cyber/AI/tech, regulation, climate change and human talent. Can the insurance sector effectively tackle any of them? Cyber is in the news all the time with companies and government on the lookout for massive show stoppers including potential catastrophic interference with our democratic processes. In addition, with half of us due to retire within the next 15 years, why is there a failure to attract and retain the right talent and what can we and the CII do about it? Finally, it is also clear that insurers simply can’t underwrite the effects of climate change, so what will then happen? This will be an interactive and wide-ranging talk and those attending will be actively encouraged to contribute with their own experiences and views. We will look at the differences in responses between insurers and brokers with brokers considering business conduct more of a concern than insurers.

The changing Ogden rate and how it will reduce liability premiums
The Insurance Society of Edinburgh is happy to announce a new CPD event next week. The Ogden rate may sound an obscure thing, but it has massive implications both positively and negatively on liability settlements. All brokers, underwriters and claims staff should have a good understanding of the Ogden rate in order to explain rating changes to policyholders and understand why large liability claims will now be reducing. The Ogden rate is used by courts to increase or decrease large personal injury liability claims. It was one of the main reasons why the market went so hard in recent years when the rate started loading liability settlements, and it will be one of the man reasons why we will now go into a softer market due to the fact it will start discounting liability settlements from 10 January 2025. The Ogden rate will mean a happy new year for insurers. Will they be passing their savings onto their policyholders? well that will depend on how well brokers understand Ogden. This presentation will be delivered by Alan Chandler, Chartered Insurer, one of the most popular presenters in the UK, and he will explain what the Ogden rate is and how it affects liability settlements.

Trust – building trustworthiness and trusted advisor status
In the insurance industry, in particular, we often focus on developing our technical skills, and our product and service knowledge in the belief that this alone will be all we need to win new clients, and then provide great service to existing clients. But of course if the prospect does not ‘trust’ us sufficiently we are unlikely to be appointed in the first place, and if our clients don’t trust us, it will be more difficult for us to bring value, and our position will be constantly under threat. This session focuses on the importance of Trust in prospect and client relationships, and how to build it.
